It's already been referred to the House Judiciary. Since it had to do with Competitiveness i'd rather much rather see it in the House Energy and Commerce or House Science Committee. Despite all their talk of 'welcoming legals, and pro-immigrant, anti-illegal immigrant" pronouncements, they haven't done much to help legals in the Judiciary Committee.

Actually some of concern of EB3 is valid.But their explanation cannot convince DOS or USCIS. According to DOS/CIS EB1 has more skills than EB2 and EB2 has more skills than EB3. That is not true in many cases. EB1 most cases are genuine except some cases in multi national managers. A manager in CTS could file in EB1 but at the same time similar manager in Intel cannot file in EB1. But only very few are in numbers because of restrictions like working in other country branch etc. So people do not bother about EB1 being current always.
Coming to EB2, the job requirement require Masters or 5 years experience. If the requirement is genuine then it is ok to give priority to EB2. But in reality(mainly consulting companies) the job requirement is decided mostly in Lawyers office or by candidate just because candidate has
master degree or 5 years experience. Though CIS scrutinise the EB2 applications still rejection rate is less. And also many persons trying to use 3 year degree and 2 year Master and apply for Eb2 by adding PG diploma etc.
So it appears that there is no difference in skills between EB2 and EB3. I wished i were here before (IV) but ofcourse its human life isnt.We learn from experience.If at all IV was here before or if there were active forums like this earlier i am not sure if i would have ever thought of coming to US.Now after coming here and learning lessons its almost like we are stuck- not only on immigration but also to maintain our commitments.There were phases wherein i was literally upset on my decision to come to US which i beleive most of us would have gone thru at one stage.
America always vouches freedom for all,but they missed the point that there is literally no freedom for those who come to US by ethical means.See the plight of USCIS.Its like a monopoly.U can hardly question.A simple example is my wifes L2 EAD.Once she got the FP notice and receipt i sent all relevant documents by USPS delivery confirmation .At the 90th day they issue an RFE asking for the same documents.If it were in India it would have been used for packing samosas.But who knows what happens in USCIS.Now we need to wait again.Can we question them on what happened to the documents i sent?Its unnecessary waste of time.I beleive its high time USCIS thinks on outsourcing to be more effective..

Just consider howmuch we spent on GC filing?I personally had to spend for filing and attorney and medical approx 7000$ (ya i had to use my company attorney as my labour was approved in last time).If atleast 200000 people did spend atleast 5000 ,then see how much we spent .Atleast 1000,000,000 dollars inside America during June to August 07 out of which atleast 50% to USCIS for something which MAY OR MAYNOT happen after years.And again a confirmed money 1500-2500 dollars every year for attorney+uscis fee for EAD and AP.The figure which i mentioned is just for an example,the actual figure might be twice.
In addition we spend on travel .A typical Indian Trip for a family of 4 would cost atleast $5000 on Air.If these taxes are considered see how much we contribute.And yes we pay for SSN,medicare for americans to enjoy at florida after 60.
Inspite of all these,some people here think we are just to steal their jobs and send money to India.If people dont realise they are competent,then their way is to oppose immigration reforms.
I have seen lots of Americans here complaining on stress and taking stress releivers and yoga.I am sure their life expectancy would be reduced to 1/2 of what they have if they were to undergo immigration inside America now especially from retrogessed countries.Serious its not a joke.:D

I am not sure if it's that easy to figure out from wage level whether PERM Labor falls under EB2 or EB3 category as there are PERM with wage level IV and Job Title Welder (which I assume cannot fall under EB2 category) and besides that for Microsoft out of 1200 labor only 44 are under Level IV.

IV has feeble power when comapred to the massive muscle and money power of various lobbies who are stacked against us. In this context saying things that could undermine the unity of IV members can only further undermine any future efforts. Are you saying IV should "rat out" these people who have fake jobs and work for body shops?
A very dissproportionaely large number of EB3ROW and EB3I were adjudicated last June 2007, one ecould say at the expense of EB2-I. It is not unreasonable for EB2-I members to feel this way.
The question should be what to do now? There is no other way than lobbying for recapture bill.

Eb2s getting or not getting their GCs doesn't necessarily register on our emotional scale, when we are looking at our own situation.
Further what really gets to me (putting it in a civil way), is that some people make use of obviously illegal things and then lecture us that we should be "happy for them" and "we should support them" (maybe they are not the same people, but some part of the problem can be attributed to this situation).
Well if the jobs are fake, then IV need not rat them out, but with people saying the law is implemented right, maybe we should help in implementing it in a more "righter" fashion. Why not? I was just trying to point out that people who are poo-pooing us need to look at their own legal standpoint (that is not to say that I consider any of the poster who is going vitriolic against us to have used that method).

Subject: Injustice :mad: for people with priority dates in '02, '03, '04 etc. who are still waiting for their labor certs to be processed using the traditional process - we want to file a case against DOL's lethargy - Let us join together and file a case against DOL and bring justice to this unjustified system.
The manner in which the backlog reduction center have been processing the
labor certs seems to be very unfair for people like me and others who have been affected. I know of cases with priority dates as late as 2005 that have gone through the traditional process and have been approved already. And there are cases like mine and others with much earlier priority dates that haven't been done. This is very unfair and unjustified. It is like we have been standing in the queue for several hours and a person who came much later than me just sneaked into the queue and got his service done while I am still waiting for my turn. Also the fact that now the UCIS has made the filing of I-485 current adds more insult to the injury that I and others in my position have endured.
The fact that the I-485 was made current and then withdrawn was made a big deal and people wanted to file cases, whereas the plight of people like me who are still waiting for the labor cert to be cleared has been totally
ignored, inspite of the fact that people who applied for labor much later
have been approved through the traditional process.
We want to file a case ASAP with the DOL or other relevant
authority regarding this issue and the unfair way of the process that we
have been subjected to. So can all those folks who have been affected by this join and voice your support? We shoud put up this fight because this is in no way justified. Why would it be?
The next steps should be:
- Get all of the support we need from all affected folks ASAP
- Get in touch with a lawyer who can help us to prepare the case
- File the case in a court against DOL

Here I want to make clear, FIFO for taking labor applications and sending ad instructions not for approving. I know depending on compilcation of cases(I think), some cases with PD 2005 get approved fast and cases with PD 2003 are taking longer. I know of the two different employees with the same employer with similar jobs/descriptions, one with PD 2005 approved and another with PD 2003 whose application hasn't even been taken for processing. So the behavior of the BEC just seems to be random and there seems to be no particular logic. Complication of the cases is definitely not one of the reasons as far as I know.

trouble is that labor certification is not explicitly mentioned in 406 (although that seems to be the intent). Besides, section 405 says that those with "advanced degrees" in STEM and who have been employed on NIV can directly apply for change of status subject to per-country caps .. then again there is mention of a special labor certification process for those with advanced degrees. So i think the conclusion is that while labor certification wont be done away with , there will be special handling for those with STEM degrees .. and those with 3+ years experience AND STEM degree wont be subject to per-country limits.Again, lots of ifs and buts in the whole thing .. we will have to wait and see.

Fragomen applied for my PERM application last year. The rule is - either advertisement start date or end date should fall in "wage survey duration of 3 months". They didn't follow that. And my PERM got denied. Immediately they applied for my PERM. And it's stuck in Audit. And not to mention, even though it was their mistake, they took fees from employer for filing 2nd PERM.. saying DOL wasn's clear about this rule, and never rejected any application before for this reason.. So its not their mistake!!

A ton of EB3 cases with early priority dates came out of the BECs in 2006. Plus the end of labor substitution acted as a trigger for people to use these priority dates. I know my company systematically went through and substituted newer filers so they could get these older priority dates.
