LOL...Couldn't help myself after reading this thread... Guys who are frustrated..i totally commiserate with all of you who are stuck in BEC..All the july filers would be eligible to file for their 485s and would get their EAD's ad AP's a couple of months earlier than the folks stuck in BEC.The BEC folks would get them too when the dates move starting Oct 1st.
Its ultimately the PD thats important for the green card..since you already have your PD much before than the june fliers,you always have your place in the GC line. Unless you guys come and join us its not gonna move...

H4 - must be allowed to work. American economy does not differenciate between an American and a legal alien. We all pay the same rent, same tax, same price for car. When our H4 spouses cannot work, we have to totally depend on one salary. In case of emergencies we hit rock bottom economically. Quite obviously our quality of life is compromised.
But what do we do about it?

People feel as if they have achieved something big after getting an EAD. EAD is not a visa and EAD status is not a valid status. You in fact lose your h1b valid status once you invoke AC21.
I have personally seen people change their attitudes as if they have achieved a gold medal in Olympics and talk big about "'Fingerp[rinting", about AC21, as if they have written the AC21 law. Does anyone know how AC21 came into picture on the first hand? There was an advocacy group called "Immigrant Social Network" that was behind the AC21. Prior to that, EB rules were extremely stringent with no portability.
Everyone browses this website, gains knowledge and behaves as if he/she is an immigration expert and has achieved something big.

Hi guys,
I have just called the USCIS. They told me that the applications will not be rejected but just put on hold until our visa numbers will be avialiable ifor the nerw FY 2008.
In addition she told me that the Nebraska office is sending back the filing receipt to the applicants which it should not affect our h1-b visa status in case we are going to travel.
For the last part I do not believe her. Is there anyone else that can confirm that ?

Nola, your intentions are good, but I do not agree with your conclusion. You are biased against yourself and other applicants.

I understand what you are saying. Both, the applicant (or applicant's attorney) and CIS shold follow the correct procedure. However, there should be no elation to getting a GC when the PD is not current, hence there should be no distress for its "revocation" - which again is a matter of semantics, there is no GC, hence there is no revocation.
I commented on what the applicant and the applicant's attorney should do based on what is ethically and legally appropriate. I did not comment on what USCIS may or may not do to resolve such a situation.
I understand the struggle you metion; I have been in the US since 1994, i lost my priority date of Aug 2002 due to impatience with the backlog center. I started my GC process in 2001! I had a job loss due to Hurricane Katrina. I am married to a US Citizen, but cannot get sponsorship from that marriage due to DOMA. The pity list goes on and on for each and everyone of us. So believe, me, i understand the aspect of "struggle" that each of us has had to endure or is still enduring in order to get a GC.
I don't see how I am biased, especially against myself - that doesn't make sense. I am not an attorney, obviously, but i work very closely with attorneys, well it is essentially my job to work with them and the bottom line in every contractual arranagement or when applying the law, comes down to what are the obligations of the entities involved whether it is a contract or the practical application of the law.

Hi Prince,
I went thru posts on other forums with I 485 denials after 180 days of filing. In almost all the cases, people filed MTR and their I 485 was re-instated back to normal after that. You should be fine after filing the MTR with the help of attorney.
I know these 15-20 days will be hard for you. Hang on. I had the same experiance when there an RFE on my I 140.

Immigrants have always been hated and reviled by those that got here earlier - but the current anti-immigrant sentiment is vastly different in scale and sophistry due to the times we live in. If every IV member signs up 10 citizens to the immigrant cause, we should easily be 100,000 strong in a couple of weeks. Consider the way CIS was initially dedicated to 'researching' immigrant issues that they would complain about the media's positive stories about immigrant contributions as merely anecdotal evidence not worthy of rebuttal. Now they are suddenly fond of anecdotal evidence themselves since experts began demolishing their claims of job-stealing and other baseless charges convincingly(esp CFR's Sebastian Mallaby) using empirical evidence-they shamelessly stoop to use someone's sob story to make their case. So, as repugnant as their motives are, they are too transparent for their own good- and they can't cover their tracks -which is good for us since we are appealing to the fair minded. Remember - every one in the US is an immigrant or an offspring of one. They have always been hated and reviled -so if someone who benefited from the immigrant tradition of this nation wants to turn around and deny it to those following him/her even though their ancestors did the same thing at a great emotional/economic cost to the then existing natives- they have a higher bar in explaining why the current bunch shouldn't continue to benefit from the great tradition-merely being bigoted but sophisticated enough to hide it isn't enough. so don't lose heart but dont sit on your ass either.

I have been speaking to colleagues and friends. Not many were aware of the rally others didn't think it would make an impact.After I showed them the website and BBC news article they were listening. I was hesitant to come there now that i was there i will attend a 2nd, 3rd and everyone. People in different parts of the country should lobby and bring 20-30 people and then you'll see numbers. Before the rally run some ads on popular channels and newspapers and motivate them.

I agree with you 100%. As this is true, lawmakers are very well aware of our grief, but none of them is saying it. They want to oppose legals in the name of opposing illegal immigration bills. If you look at CIR in 2006. First they put legals in the bill with illegals, then they oppose illegals, ultimately the result is no legal immigartion too. Nothing is getting passed in the congress for the legal immigration. what does it tell ?

Also, if our fate is still so tied up with 12+ millions illegals, doesn't that mean that we failed to make our case, even with so much media coverage, lobbying and our personal efforts to call the law makers. Could another explanation be that lawmakers have all but refised to treat us with dignity we deserved as an educated, law abiding, tax paying citizens contributing to the society. I believe that we didn't fail and we tried what we could but still lawmakers refuse to act on our casue, may be they are implying something without explicitly saying it ?

One change I noticed.
Now people can continue in the old system if the I-140 was approved or pending before the first day of the fiscal year subsequent to the the bill being enacted. So if the bill is passed right away, you need to have filed your I-140 before Oct 1 2007.

They did a good job. My only complaint with they kept changing the paralegal that was handling my case like 3 times during the whole process. Otherwise no problmems.
First thanks to those who put there first hand experience in this thread, it made me think again. And now I am deciding to cross the border and go north, after 9+ years in US on H1b.
Could someone please refer a Do-it-yourself kit that they have used and/or immigration consultant?
I contacted one consultant, they email almost every week and when I called/emailed them saying I am ready to pursue there has been no response from other side yet.
It will be great help for me if you could refer a kit or a consultant.

We are quick in jumping at each others throat for no apparent real reason ! Being part of a forum is sharing space with others, with those whom you disagree, and those who disagree with you. Argue logically, but don't make it a personal fight.
Don't agree with someone, make your displeasure known. If things seem to be getting hotter, ignore the other person. Live and let live. We have bigger issues to worry here - GC mess - instead of who said what !
