Attorneys please advice on my case below....
I applied for an I-485 during July Fiasco under EB3 category with an approved I-140(EB3). EB3 priority date is October 2005.
I also started another process later in EB2 category with same employer. My EB2 I-140 finally got approved recently and successfully porting the priority date from EB3 but did not file for I-485 in Eb2 yet.
Last week, my EB3 I-485 petition got approved even though my EB3 prority date is not current. I have got my welcome letter (I-797C) today. The COA is 26 on the notice.
My questions are:
Is it approved by error?
What are the risks involved for now and down the road.
Can we travel outside United States using this GC.
Will appreciate any advice.

You can initiate the process for both of you individually. Means u can apply Labor, I-140 individually. After that while applying I-485 its advaisable to move with the lawyer suggestion. So till I-140 you both can apply individually.

it asks last five year employment history , i have not worked in USA for the past 3 year but i have worked abroad before these 3 years.. should i write it in the column or i should write NONE as i have not worked here in USA .... i am not the primary applicant ... my husband is primary applicant

please post your experiences regarding recent RFEs for EB2 and EB3 to EB2 conversions. please include details regarding what the RFE was issued for. I am startng this thread because I am hearing different things from different people saying EB2 is being scrutinized more(especially EB3 to EB2 conversions) and this is resulting in more RFEs. I need every body who received RFEs recently to comment on it so that we can arrive at an accurate assessment. I am expecting that EB2 India/ China will continue advancing in the next few months. this will indirectly benefit EB3 India also as there will be unused visa numbers that will overflow into EB3, but the only problem is if applications are scrutinized, then the RFEs may delay processing for many people with earlier PDs even if their date becomes current.

IV website service provider has informed that they will be installing new hardware on the core switches that are used by IV servers. As such there is a scheduled down time of up to an hour which will occur on October 24, 2008, sometime between 12 AM CST and 6 AM CST.
As such access to IV website may be intermittently interrupted during this window on 10/24/2008.

I have filed for the 7nth year extension based on my pending labor (365 days old). The perm is picked up for an audit. Incase if the perm is denied, will h1b also be rejected ?
As per my understanding, your H1 will not be denied but you will not be eligible for any subsequent extensions unless at that time you have one more perm pending for over 1 yr or I-140 approved.
I would recommend you find another employer or file perm through some one else as future employee. 30% perms in audit are denied after 2 yrs wait.

My labor/I-140 documents show my salary to be 85K, I am yet to receive my I-140 approval from Nebraska Processing Center, filed in June 2006 under EB-2. Would it cause any problems when I file my I-485 ( priority date March 2004 ) next year if the salary for 2006 is less than 85K ? I was unemployed for two months this year unexpectedly. Thank you for your responses.

He is my attorney for my GC process. He had successfully done my PERM application last year and now we are processing I-140 from last 4 months. Best thing is that he is quick and his paralegal call/email you whenever they miss any document instead of waiting for long time and going thru employer channel which consumes lots of time in between.

LCAs for consultatnts definitely are challenging, since they move around so much. In your case, a new LCA is not required because the new position is in the same Metropolitan Statistical Area (basically the same town) as the old location.
In general, CIS and DOL distinguish between employees who are roving as part of their job, and those who are sent to a new location for a short term. The distinction is too complicated to go into here, but hopefully your company's attorney is well aware of it.

Hello,
I was wondering how long it took for everyone's check to be cashed once their packages were received at the TX service center? I'm worried because from what I read before the check cashing was almost immediate, while getting a receipt actually took longer. My package was received and signed for by Michael Salcedo on November 13th, but the check still hasn't cashed and I do not have a receipt. My husband and I are planning on travelling to Canada for Christmas, will crossing the border be a problem? Any advice anyone can give would be great! Thanks in advance!

It wouldn't have quite the resolution of the 20D, but the build quality and speed is undoubtedly somewhat better. If I could afford one today, I'd get one. :D

I got my labor approved in Jan (EB2 - RIR) , I say EB2 because because all the documentation was done supporting EB2 (BS + 5 years). My job requires that and I meet the criteria.
However, when Applying my I140 , the lawyer screwed up and filed under EB3 and got approved.
I very much want to go for EB2. Is it possible to file I140 again under EB2 with the same LC? If I want to re-file, do I have to or do they (USICS) cancel my previous I140 approval ?
Is filing another LC under PERM and I140 safer route than using the current LC ?
What is the best course of action ?
I know there is a clear advantage today in being in EB2 over EB3 (PD wise) and it looks like most people are converting from EB3 to EB2. I am not sure whether there will be any advantage of being in EB2 over EB3 by the time my PD (oct 04) becomes current.

yeah you can go to canada, or mexico. even india, i went to india.
All they look for is funding, if your wife has funding from the university in which she got admission that is enough.
