I was trying to know what are the possibility of those people who have ported successfully and still got their GC approved.
I realized that people who already got their GC won't be visiting this site. But, if you have known somebody who did, vote on the poll please.
1. Changed jobs --> interview --> got GC (no RFE)
2. Changed jobs --> RFE --> invoke AC21 --> interview --> got GC (invoke AC21 only when requested)
3. Changed jobs --> invoke AC21 --> interview --> got GC (invoke AC21 voluntarily, but no more RFE)
4. Changed jobs --> invoke AC21 --> RFE --> interview --> got GC (invoke AC21 voluntarily, but still get a RFE later)

Can some one file for H1 transfer when his/her H1 extension is pending?
Also there is a RFE on H1 extension which the company is responding.
Original H1 expired 2 months back but have a valid I-94 till december.
Used AP to re-enter so I-94 has Parolee status.
please advise.

A reader sent me a link to a post at the The Future of Capitalism blog reminding folks that being pro-immigration fits right in to a conservative agenda: David Cameron, the British "Conservative" Party leader who favors a top income tax rate of 50%, also wants immigration restrictions that would limit Great Britain's population over the next 20 years to 70 million. I am on L1B visa from Apr 2008. I have my PERM and I140 approved.
I got a email from my attorney stating that they want to file my H1B petition this year so that they can keep on renewing my H1b as long as my company wants.
Suppose they file H1B COS petition then my status will automatically change on Oct 1 2010.
I am planning a vacation to India in November 2010, what are the options with me when come back to US.
- Do i have to stamp the H1B visa OR
- I can still come back on my existing L1B visa ???
Please suggest

For how many years does the employer have to guarantee that it has funding to pay my salary? Or how does this thing work out. My employer has 300+ employees.
Any other requirements from the employer?

The employer has to be big enough (300+ is a big company) or if small (such as less than 15), it has to show company's return and sometimes business in hand.

Yes something basic seems to be missing in our immigrant community. I want to repeat these are just 6 users who are very vocal and influencing thousands of people.
Sorry to say this, but it appears our worst enemies seem to be fellow immigrants, not anti-immigrants.
All I can say is someone has to be criminally negative minded, to oppose a campaign where money is not even being solicited. This culture of hate has to go and has no place in the USA.
This campaign along with the DREAM campaign was also supported by Murthy forum.
Murthy is one of the top immigration lawyers. It is a moderated forum, and the lawyers are personally aware of the content. They have supported us on previous Advocacy days.
As far as the question about law, I am no lawyer and will defer to admins. Core is in touch with many lawyers and I can assure you, they will pick up an action item, only if it has a very good chance of success.
Also Greg Syskind, one of the best lawyers in the country is on our advisory board, and core talks to USCIS, law makers regularly. So to claim this is not legally possible is just absurd.
On our home page we have the best minds on immigration listed, in our advisory board.
So you have all the above lawyers, lobbyists, core who are supporting this and 6 people with EAD think its not possible?

All they care is their green card..rest of eligible people who are waiting to file 485 can have unknown waiting time for their chance of filing 485 and can live in the state of limbo.

The USCIS announced on June 1, 2006 that the regular H-1 cap for Fiscal Year 2007 (FY2007) was reached on May 26, 2006. Those cases properly filed with the USCIS before the 26th are safe, with respect to the cap, as there are enough cap numbers for these cases. Cases that reached the USCIS on May 26th are in an uncertain situation and will be subject to a random selection process, as there are enough numbers for some, but not all of the May 26th cases. Any regular cap-subject cases received after May 26th will be rejected entirely.This information does NOT impact advanced degree cases, for which cap numbers are still available.

My husband I-140 receipt notice has a wrong receipt date, instead of june 20 it has july 20 receipt date, the rest of the forms like I-485,Ap has the right receipt date, since he filed for labor substitution receipt date is critical since the deadline was july 16, what should we do anyone has the same situation pls help:confused:
