I am in almost exactly the same situation as you... I wonder if this can be done as well... On the other hand, as long as AC21 and EAD are prevalent (as long as we can indeed get 3 yr EAD) it is atleast not as bad for us...

Yeah agreed...atleast we r lucky in that sense. But looks like now EB3 is not going anywhere. I might be wrong but till I dont see some good movement in EB3 category I choose to remain pessimistic...

This is like telling passengers to move to the other side of the boat when it starts sinking one side. The outcome is only making the boat sink faster. Remember, the huge backlogs are not completely due to unavailable visa numbers.
Unless there is a real need, moving from EB3 to EB2 dont make much sense.
If your case is EB2 worthy. It makes a lot of sense. I have many friends who did that and they have their GCs now. While I'm rotting in this mess... my fault: I didn't convert to EB2 which I could have.

If you want to file law suite, you should have done that long back.
You should have done it when PERM was brought into process. Also, there is nothing said in PERM process that people should not re-file.
But blaming the process just because every one is made current is wrong. If some one knew the know-how, and was in hands of a good employer, even people who came in 2007 are ready for 485.
The whole immigration system is messed up. It is sad to see people stuck in BEC suffer, but you all had every chance to re-apply and you have every right to be in front of perm people, so is it goes when USCIS is assigning numbers.
Also as posted by members, if all cases would be cleared by 2007 Sep, than you all have high possibility to be in the next VB, which could only be few months away. Also they might bring speed 140 back.

But don't you need the original LC approval notice for concurrent filing? It was already included in the I140 filed on July 17. I will just hope and pray that I can receive the receipt notice (or at least receipt number) before August 14~15. Thank you, SVAM77!

is UNLIKELY to pass at least in its current form. Public hospitals, underserved area clinics, Universities are not Google and Oracle!!! They'll go under if they have to pay 5000 $ for H1Bs. People probably don't have the faintest idea under what kind of financial strain these are. There will be exemptions for universities and non-profit organizations.

We do NOT support H1b increase without first reforming the EBsystem - we are neutral on this issue. There is nothing for us to gain by either supporting or opposing H1-b increase. We cannot support it because it worsens retrogression. We cannot oppose it for the simple reason that we are ourselves on H1-B. If someone thinks H1-B is bad, then how on earth can you justify giving GCs to these H1-Bs ? Why don't we start by deporting ourselves then ?
The reason zazona and numbers USA are "successful" is simply because they are citizens groups - and they have a sympathetic audience of folks who lost their jobs, as well as sympathetic mouthpieces like Lou FOULMOUTH. Politicians are bound to give weightage to these people's concerns (valid or not) if they wish to remain in power.
Lets leave H1-B bashing as an exercise to the zazona,foulmouth and co. We have scarce resources to begin with as it is, and they are best spent on something constuctive.Unfortunately, we do not seem to have any shortage of ideas on what new items IV should be working on.

USCIS is clearly requesting for two passport size photos with AP application.
It is surprising that most people don't even read basic instructions with the USCIS forms, and go on asking questions and sometimes giving (wrong) suggestions in IV. Yeah, it takes a few minutes to look through the instructions but searching/writing/replying/ doubting/making mistakes/giving red dots/ etc in IV takes more time, I think. :)
I e-file my AP and I got receipt notice immediately after completion of e-file. And I got the direction on the PDF listed bellow. USCIS clearly mentioned DO NOT send Copy of ID, Photos unless they requested. That�s why I didn't send any documents to USCIS.

LAR (Last action Rule) will not applicable in this case. It is applicaple only in change of status ( like H1B to H4 or L1B to H1B). Not in H1B to H1B. If you continously maintained H1B status, you are OK, as long as the H1B approval is valid employer2. Employer 1 or Employer 100 can file H1B, even without your knowledge. Therfore, you dont worry. As you were authorized for employer 2 for that period and you worked for them in that period, you are OK. Exlain them in detail with the evidence of H1B approval for employer 2 and pay stubs. Any way, consult an attorney.
Trouble is only if this is a transfer. By the way LAR is applicable on status (L1,H1, H4 ect.). Work for Emp 2 is whether "authorized" by CIS or not, depending on New H1 vs. Transfer.

Hey guys
Just received email from CRIS regarding I-485 denial notice for both me and my wife.
I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.
My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.
My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.
This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.

My case was AC 21 and fortunately my I 485 was approved last month without any RFE, but before approval I spoke to NSC customer service and got hold off a very good guy , who happened to be very helpful, he mentioned that the letter requesting to port the employer or change of attorney need to be addressed to appropriate division, failure to do will cause all these problems, since it take time for the USCIS to route the letter to correct division and most likely getting lost. The only solution to address this kind of problem is to bring the much needed regulation to AC 21 , a formal application process where we can track the progress.

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?

I doubt if the house is going to toe the senate line on the CIR. The new bill that has been introduced in the House is seen as a rebuke to Bush, directly contradicting the Senate version. I think this CIR will be killed in the house if it somehow passes the Senate.

Unlike many members here I'm not that pessimistic about our chances in the house since the Chairman of the House Immig sub-comittee Zoe Lofgren is pro-immigrant.

I could not believe it either. My PD is August 2003 and EB3 from India. I have read many stories where people seem to have got GC when their PD is not current. In some cases, it appears they keep quiet about, but in some cases people seem to have corrected the situation to avoid any future complication, for example, if one decides to become U.S.Citizen at any point. It is just frustrating to think that I probably need to spend a lot of money on an attorney and go through the mental stress in resolving this because of probably an error some foolish clerk at USCIS made.

I would suggest you to enter your receipt # in case status tracking system in USCIS.gov and verify. You might have wrong receipt # in your profile.
