I�ve been laid off as of Friday last week.
My employer started laying off people an year ago and there were too many cycles so far. I was immune to all those layoffs until Friday. They eliminated everybody in my team, 15 people in total.
I am in the final stage of my GC and I have 2 year EAD. My H1 is expiring in March and my (ex) employer already paid my Attorney for the 3 year extension. They have decided to extend my H1 and paid for the expenses. But in the mean time, they were forced by the investors to show profitability and hence the layoffs.
My (ex) employer is based in Massachusetts and my Labor Certification was done from this location.
I have received job offers from some of my employer�s clients. However, they are based in other States (CO, OH & WA for instance) and they might not be able to do my H1. One of them is interested in hiring me on a contract basis, since they had frozen new hiring.
Is taking a job outside of Massachusetts impact my pending I-485? or Will it violate my Labor Certification conditions? I couldn�t find an answer for this anywhere.
Also, can I take contract jobs for the time being?
I sent out an email to my Attorney with all these questions. But, he is not available until Tuesday next week.

As long as your job responsibilities are same or similar, your should be good to go. You are probably confusing between Labor Certification and LCA. If you use your EAD, you can work anywhere in the US. LCA filing is done for H1B and there you could specify the job location but not in a Labor Certification filed for the GC process.

Hey I have the same issue - did you have any issues to get ur visa stamped for company A. I am leaving the country for a 2week vacation and have to get my visa stamped. I never joined compnay B even though the visa transfer was approved last august. I am still working for company A. A reply would be appreciated. Thanks

Thanks for the post. However I read testimony that said more than 80% of EB visas have been used up. That leaves only 28k (20% of 140k) at most as spill over for Fiscal 2008. Thoughts?
My understanding is they wait until last quarter to give the spill over. But this time they started giving the numbers in 3rd quarter itself. Keep in mind EB1 is current and Eb2 except I and C is still current.
I expect to see at least 20k visa's issued to EB2 I and C.

My I-140 is approved and already filed I-485. Finger Printing completed twice and Medical also completed. My PD is Sept 2005 filed at Texas. Texas Processing completed for I-485 shows Sept.2006. This means my processing is completed and now the PD is current can I expect the Green Cards ....what is next??

Call the 1-800 number in the approval notice and select the options 1->7->4->3 and they will be able to help check the status of the application. You need the receipt no when you call them

I've the same question. If I complete an online Masters in info tech from a reputed university, with the SKIL bill, can I jump the queue?
Will a part time MBA / executive MBA from reputed university do any trick for the existing H1b holders? I am not asking this for GC, but it is mere co-incidence with SKIL bill and my intention of doing MBA.
The very first para in August 2006 visa bulletin says...
This bulletin summarizes the availability of immigrant numbers during August. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; the Bureau of Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible under the numerical limitations, for the demand received by July 10th in the chronological order of the reported priority dates.
MY COMMENTS:
In may it was Apr'08, then it was Apr'15 and now it is again Apr'01. So when the dates are in April 15, more people have applied for 485(than I have imagined) to consume the VISA availability quota. I wonder, if those many people are there from 2001 April and before to consume the quota, then when will the datel move to May'01. Forget about the visa dates moving to July/Aug/..Dec 01.
If the SKIL bill or any other provision is not passed into the law, it is always better to have a secondary plan to save the career at least. It is better to think our family and career assuming what we will be doing if the priority dates does not cross Dec'01 in the next five years.
I personally think to move back to India if I do not see anything by march next year. Already I am in the end of seventh year. If the SKIL bill is not passed, I donot want to do a MBA here by spending 40K(partime ,100K fulltime) and then doing a sr.software er job. With the spagetti law, I cannot change my roles whatever qualifications I add after applying for my GC. I have been postponing the idea of starting my MBA for long time becos I would like to file my 485 before I work on that. Otherwise it is waste of time, energy and money. What a HELL...............

No need to jump the gun. I didn't ask it at a personal level, in case you didn't understand it! Instead of nitpicking on a single statement, read the whole paragraph! There is nothing impossible in life!!! Those who haven't yet decided to go to DC, you can still make it!!!! If you are withi 4-5 hour driving distance to DC you have to tell yourself that there is no excuse not to attend! Just hop on your car or the train/bus and come!!!! GUYS, WE REALLY NEED YOU! These idiots forget that passengers are paying the airport landing fees and refuleing charges etc. Those who forget customers end up loosing business. We flew by Emirates last tlme directly to Dubai. It was excellent, took less time compared to landing in Europe.

The visa restrictions, Cap and rules for H1 and H4 all were framed to protect American jobs. If H4 is given work permit then there is a fear that one more job may be taken from the American people. I am not telling it is correct but everyone are in that situation. Also we cannot resolve all the issues. L2 can work H4 cannot work is discrepancy. But one person working in a home will not have any stress especially when there is kid. We have to consider this is an advantage
