    Since I was bored at work, I called this number and talked with a rep this morning @10. She told me that they have 76K applications pending for the receipt date as of July 27th. She said this two times thinking me to take on with surprise with this huge number. Yes, of course I am surprised. Is it only 76K apps by July 27th?

    Set up for $50 recurring contribution. Never in my life did I felt so charged up as I did in last few days. Thank you IV for inspiring.

    I feel there is value to creating atleast "paid members only" section in addition to regular free zone, so that quality of dicussion is elevated.

    Then it wont be a non profit organization any more. You can ask for donation but cant force for it.

    Retrogress is against the principle of laws. Think about the reason that the government wants provide a path for these undocumented people is the government wants secure the border. Before the law take effective, they need find a way to take care of these people because new law can not have retrogress. Same should apply to the legal immigrants. When the new law is being discussed, it can not terminate or replace the current law. I don’t think people interpret the words correctly. I believe introduction means the period of time before the signed new law replaces the current one.

    Law execution shall favor the executed person. I don’t know how to describe it in a professional matter. I give an example,
    Person A is sentenced to death and will be executed on June 15th. However, new law takes effective on June 5, and according to new law Person A shall be sentenced 20 years in prison. So Person A can appeal to change the sentence.
    On the other hand, Person A is sentenced to 10 years and will be executed on June 5th. But new law will take effective which gives 20 years in prison. So will the person get a severer penalty? I don’t think so.

    In addition to that, when a new law is dramatically changed, compared to the current law, an introduction period is usually applied. During this period of time dual status may apply. People may choose either law which is favorable for them. Of course, because of the uncertainty, lawyers love this dual status to get more business.

    There appears to be a big time gap between the date one receives the USCIS email and the date the documents are actually delivered.

    Landed in july 2000

    Changed employer in nov 2000

    Joined a fortune 10 company in aug 2001, they had a policy to wait for 1 year before any GC application.

    Started process in August 2002, Finally labor was filed in March 2003

    May 2004 Company bought another company and in merger my department was closed, Was laid off in October 2004, was lucky enough that a job I had interviewed internally came through. Started with them in October 2004 but with a 20% salary cut :(

    Finally labor was approved in 2005.Got 140 approved in Jan 2006.

    Dates became current in June 2007 but lawyer delayed the filing till July when all dates became unavailable. Due to political pressure dates became current and was able to file for 485.

    Got married in Nov 2008.

    Company bought another company in 2008 and the merger resulted in job loss again in April 2009.

    Was lucky enough again to find another job in the company.

    Within 1 month got another job offer in the company with a promotion. So after 2004 came back to original salary in 2009.

    Still in 2010 I am not making as much money as I made in 2000-2001 when I had just landed.

    Talked to my new manager in Dec 2009 to apply GC in EB2 since it is a VP position with 8 year experience requirement he said a big NOOOOOOOO.

    Finally boss agreed to start the new GC in EB2 in July 2010.

    Talked to lawyer and after evaluation they agreed that my new job is more than 50% different from my old jobs and hence I can use the experience.

    Started the process with the lawyer but since it is a big company all processe take forever to begin :(

    I understand your frustration. Since there is no spillover in the first quarter of new fiscal year, it was expected that PD would move back. How can you you expect 2006 PD for Oct when there is no spillover visa numbers.

    Next year Jul-Sep 2009, PD should move to mid 2006 again.

    USCIS currently has no accountability at all. Nor do they seem to have any clue about how many cases they have in the queue. Just see EB2-I dates for all the 12 VBs for the 2008 fiscal year: It started at 1 APR 2004 then retrogressed back steadily till it eventually became "U" just to jump back to 1 Aug 2006 for the last 3 months! Now after one whole year of processing and approving some 20-30K green cards for EB2-I it is starting at 1 APR 2003, a full year back from where it began last year!! Meanwhile they have handed out thousands of green cards to PDs in 2006 when the rule clearly states they have to clear older PDs first! Care to explain, USCIS?

    I know people are sending out mails and DHS-7001 forms on their own but these individual scatter-shot attempts will all vanish in a big black abyss of USCIS bureaucracy and fall on deaf years. Only chance to instill some sense in this adhoc process seems to be if IV as a whole organization takes up this matter with Ombudsman and influential congressmen/senators like Zoe lofgren. IV had been very influential in redressing excesses by USCIS in the past - turing back July 2007 fiasco was no mean feat! Can we have some IV action item from core for this?

    I'm afraid unless we do something about it as a group there is absolutely nothing to prevent USCIS from doing the same outrageous thing year after year with little fear of any retribution. We will all be practically at complete USCIS mercy!

    Finally, I'm nothing but happy for those who got their GCs in this last round of "Lotto drawing" - including those with PD much later than mine - but the prospect of being stuck in a black hole called USCIS year after year scares the hell out of me!
