    In fact a fellow indian wearing a turban tried to get into the consulate just before the consulate officially opens. The person inside (not the security) threatened him that he/she will call security and through him out!. Thats their attitude... They (at least think) belong to ruling class of india, so they behave like that?!

    Why was your "fellow Indian wearing a turban" trying to enter the Consulate before it officially opened? The Consulate official had every right to call security and "through out" your "fellow Indian wearing a turban". If your "fellow Indian wearing a turban" had followed the rules and not tried to force his way, maybe he would not have been treated thus.

    Here's a thought: try doing the same here and see how well you are treated.

    How we are getting 50k is like this.

    1) EB1 Over Flow (50% of EB1 was unused last year) 46k/2= 23k
    2) EB2 Over Flow , this number is still fuzzy. But lets say around 10k.
    3) EB2 India has quota of 3500.

    So approx 40k.

    Correct...This is a new thing starting this year. And as long as this interpretation holds good, we will see similar excess numbers available to EB2 India/China - until they become current.

    Then these numbers will pass on to EB3 ROW

    Then after that category becomes current, numbers will start flowing into EB3 India/China.

    But all this is assuming, the number of GC applicants per year is less than 140/2.5 = 56K/Year + their interpretations do not change again.

    I for one, would not be surprised to be see EB2 India move to 2007 next year.

    No one is talking about what happened in Apr-2001. Bill Clinton allowed all illegal aliens to file AOS in EB-3 category. That brought estimated 8-10 million filings in Jan-Apr 2001 under EB-3 category. That's why it took so long for EB-3 to get past Apr-2001. With EB-3 having a number cap, I still have a feeling that those estimated 8-10 million are still floating around in the system and dragging EB-3 category. Any thoughts on this?

    I had a similar experience, i took matter with the consul general, other than making an apology in the written e-mail I dont think he took any steps in improving the Customer Service @ SFO consulate office. I sent them US postal Money order, so i dont think they duped me...it just cost me extra $20.

    Babu mentality is still their for any Govt of india employee and no matter what position they are holding, they all behave same, very rude and corrupt minded, always looking for an opportunity to make quick bucks using their position. Though in your case if you would have write the money order or cashier's check in favor of the consul general, Govt of india account, i dont think they have any legal way to encash these check or money orders in favor of them.

    I guess the fraud is when folks send them $20 bills, thats very easy way of stealing the money and especially when they send you the PIO card in the same original envelope which you sent. Something suspicious. Write to WAshington DC office and see if they take any action.

    If approached in the right way there is a chance that big law firms will be helpful to us. The way to do this is politely, not raising a stink, with a credible number of their clients supporting us. The big law firms could act as a "force multiplier" to use a military term, only a small fraction of the community currently know about us, the big law firms and USCIS are the common connection for EB GC process, and USCIS is not about to email all their customers about us. With the right encouragement law firms might just help.

    If they have members reading forums great. However, please do be civil.
    I do understand the need to vent and rant sometimes. My personal guide is not to post anything that I do not want to be publicly (or legally) held to. Also a balanced constructive post is useful for all. So I place my full name in my signature.


    Now when explained like this anyone would understand. Also do see the point you are making and is worth a try. Is the core team looking into this? Do they need any assitance from us?

    I just called Lamar smith's office, a lady took the call and once I mentioned that I'm calling on behalf of immigration voice, she immediately responded with the three bill numbers and said that she will pass on the message to the rep.

    Not even took a mt, come on folks please call his office and request his support for the three bills.

    I thought only who have advanced degree from US universities in STEM with 3 yrs exp are exempt from quota. That's what the talk all over the media. I am not sure how this is going to be, because 3 years of US experience is not very hard criteria to meet for which some of the votings won't go well. But have to wait and see.

    I think our argument is getting a bit too emotional and thought of letting it go but wanted to respond to a few points mentioned by you:

    I was Dem leaning too, and I liked Hillary. But Obama has in no way been running the honorable campaign. He is using others to do his dirty job, if you think otherwise, you too have been sold on the propaganda of the left.

    yesterday i was reading a commentary by Karl Rove, even he said that McCain's ads went too far. I think that says enough (BTW Karl Rove is master republican strategist whose tactics are famously credited for Bush's second term win - him commenting negatively on a republican candidate and saying that ads are going too far - it wont happen everyday unless they really went toooooo far). I havnt yet seen any sleaze tactics from dem side (yet..atleast).

    when obama made a sexist remark, what did the press do? Nothing. I dont know which comment you are talking about. In presidential election time journos wait for a little gaffe and make it out of proportion - even so I dont remember any offending "sexist" comment yet. If you are referring to "lipstick on pig" comment - its laughable to see republican pundits trying to imply that is referring to Palin - he was talking about the new found "change" message and how their new campaing wont change their old policies. Incidentally McCain seems to have made the exact same comment on Hillary herself during primary season. Yeah the same press was sleeping then.
    Let us see what happens if his opposition makes a even a hint of racist remark. I am sure then that the republican campaign will be pounded by every media outlet in the country.
    Dont even mention about race. We all know that Obama's race is to his disadvantage - just ask elder white voters from south about the prospect of voting to a black candidate named barack obama - whether they say it explicitly or not we all know in our hearts that race does play a role in voting and it is to his disadvantage (I was listening to an NPR public forum where some people insist that Obama is muslim and that is their main concern - this despite of repeated clarifications from him saying that he is a christian and despite of a major controversy surrounding his christian pastor; I wonder if same suspicions would have persisted if its a white candidate named John Smith). The notion created by some pundits that Obama is trying to exploit his race towards his advantage is idiotic in my opinion. Being a racial minority myself with a strange name and an exotic religion (struggling to get a greencard :)) I know what it would have been taken for Obama to came to this stage. I cringe when people suggest that his success is "because" of his race - it is actually in spite of his race and in spite of his poor background (he came from even poorer background than most of members here I guess, he and his mother lived on food stamps for some time). Yes media might have gone overboard about his candidature at some point during primaries - but that honeymoon is long over and in fact these days McCain/Palin are getting a free ticket.

    Again, not to say I like republican ideology, I am very left leaning in my thoughts and actions. However at this time, I see that majority of the left is leaning towards Obama just for the sake of leaning towards left, and not on the merits of candidacy.

    As I mentioned earlier I am a non-voter, so dont have much stake in this election (considering my GC stage I wont be voting to either of these candidate's second term too). I was just referring to the two candidates and who is running a better campaign. As an independent observer (though slightly dem leaning as you:)) of presidential politics for last several years - I think in the last two elections - trivial/non-sensical matters overshadowed real issues and look what state the country is in. The reason for those two elections getting into trivial issues is not coincidental or is it a fluke. The propaganda artists dominate and try to "manipulate" people opinion. This time I thought it would be different and seemed different for sometime but last couple weeks the same tactics came back and they are firmly followed by McCain without even regretting. That is sad.

    If I have had a vote, I would have thought about issues like economy, war, immigration, health care, et al and decided whom to vote. Republicans know that if people think seriously about these issues they would lose - that is why they are concentrating on personalities and slowly and systematically making Obama the villain who support sex education to kindergarteners, who raised gas prices even though they are ruling for last eight years and their candidate in the senate for 30 years (whose experience they tout), etc. If personalities is the only criterion, I have to say that I like Obama more since I appreciate the way he rose out of poverty and got great education and despite of lure of earning money (whose pull is more for someone coming out of poor background) he choose to be a community organizer. McCain has a pretty good story himself but he is from a affluent family with political ambitions cultivated from beginning and was taken under wings by bigwigs from early his career - it is nothing wrong but I like a self-made man who can inspire youth and old alike.

    On expereince, just having experience is of no use. A president is someone who leads and inspires the nation - he/she does need to have enough experience to allow people judge him - being a state senator and federal senator and being in the national limelight for last 5 years and being under intense media attention for last 18 months, Obama has enough experience to allow people make decision about him. What is the use of having hundred years experience without able to inspire handful of people - lets say Sen. Sessions with hundred years of experience (not exactly but close to) runs for president does he make a good candidate??? Dont you think that Obama has shown enough leadership and inspirational fire in the primaries to be eligible to where he is now.

    Both candidates changed their positions and its fair game to discuss - its also good to discuss their stands on various issues (personally I would like to know their stand on immigration in general and EB in particular - but I am sure they both would avoid talking about that) - the thing is, last couple weeks from the time Palin came into picture - issues have taken backseat and republicans seems to be enjoining that. They seems to be following the same tactics that put them in power in last two elections (in '00 the pundits exhorting people to vote for someone with whom they can have a beer with; and then exploit voting and results in one particular state; and in '04 putting mini referundums on gay marriages while the country was in a war and then swift-boat the other candidate) and unfortunately it seems to be working again.

    The DOS after consulting with attorneys and the Congress has concluded that EB visa numbers should spill over horizontally rather than vertically. Relevent legal clauses addressing this issue were posted by IV members yesterday. DOS now admits it's previous interpretation of vertical spill over (excess visas going to EB-3 ROW) was wrong. Can it be challenged or reversed?, Of course possible but very unlikely to happen in the near future in the next several months.

    All said and done, I'll say vdlrao calculations with (sumagiri correction:) look credible.

    the good point is that lot of people till end 2003 got their GC's in states like georgia. I guess many people in states like california must have gone to EB2 or gone back to their countries. lot of companies closed their shops but at the same time there was lot of labor substitution. I guess at this point EB3 - (I) cannot do much except pray and sleep(and hope one of the advisors to the president / congressmen tell them that more or speedy legal immigration actually helps US (in housing / SSN mess / medicare / tech innovation / outsourcing etc etc).
    I was talking to a manager (naturalized citizen) of a top company and he said the same ..baby boomers are /will be retiring and you will see more old people in usa rather than youngsters - this is the most important advantage that countries like china and India have (young population).

    as EB2(I) and world wide dates starts to move ahead - I guess future support to IV (or any campaigns) would continue to diminish

    whats with the quotes...comparing to Gandhi and Martin Luther King Jr...Please dont kid yourself.

    They did it for their country and fellowmen to be free from the clutches of oppression (a much serious issue than green card i think). Although even that is extended selfishness (cos of being Indian or African American) but they dedicated their entire lives for that cause.

    We are not even close...this is just for MY GREEN CARD!

    am i wrong?

    Don't you think you are not free from the clutches. If getting some green card relieves so many people from clutches why not fight for it?

    As the saying goes “the proof is in the pudding" anybody can give statements but it is the results that matter. What results has compete america achieved, they are just giving lip service. Contrast them with the health industry lobby which has achieved results year after year. Compete america ultimate goal is more h1b which they will achieve one way or the other.

    Don’t get me wrong, I am not saying compete america is bad, I am just saying there focus is on H1b and not as much on EB relief. If they face a hypothetical situation where they can get either H1 or EB, they would gladly choose h1, that’s the bottom line. Its better to have somebody like compete america rather than nobody, but we need a corporate lobby whose main focus is eb relief.

    And there is an important lesson to be learned from the health industry lobby. They just did not say they want CIR or skil and then went back when both cir and skil failed. They started chipping away at individual items like 50000 visas for Schedule A last year and 90000 this year from unused\recaptured visas. We should also be asking for our individual line item, 485 measure. This is how a war is won, one battle at a time. It is unrealistic to have an "all or nothing" attitude that people opposing 485 measure have. If the health industry lobby had such "all or nothing" attitude they would not have got the 50000 visas last year nor would they have been trying to get the 90000 this year. Hope we learn from them.


    I am not sure about the statement "There is no corporate support for EB reform.....". Check this link http://www.competeamerica.org/. They seem to have the same agenda as ours (i.e., IV's). Is IV aware (or in collaboration) with them?

    Well, it's time to break the news.:p I didn't attend the rally because

    (1) the first and foremost reason: a recent surgey at my backbone , and I may not be able to walk for more than 15 minutes continuously.

    (2) the second and honest opinion: Even If I were doing well, I wouldn't have attended the rally due to the yelling-nature of words from some of the Core leaders, and their pushy messages.

    (3) the third and final point: The rally pictures and the rally experience of other members have impressed me very much and have totally changed my mind. So, next time, whereever you organize the rally, I will be there.:p

    This is my honest opinion about my abscence. I hope noone will jump on me for my reasoning.

    Actually abolishing the whole H1B thing is theonly way. Actually IV should actively start lobbying against any H1B increase. Then only there is a chance of of corp america supporting any GC reform.

    IV should work on highlighting the H1B abuse that is going on, in the media
    so that the whole H1B will become so radioactive they will be forced to scale down or reform the H1B.

    H1B visa is the main reason for EB problems.

    No wonder that people start demanding to curb immigration right after getting their green cards.
