I think this guy is from numbers usa for sure. After writing all the BS, he asks it to take it in constructive way. There are lots of other way to express your concern if it had to taken in constructive way. This is definitely not the way.

We had several threads crying out for funds in very critical time senstive times. At those times you are a mere spectator and now just for posting this bashing post you reluctantly became a anonymous member. All these shows your LEADERSHIP skills and quality of leading the battle from FRONT. If I were in USCIS I would do a background check on these high qualities and ground breaking positive attitudes even before giving H1.
I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!
That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.
I know IV works like dIVorced wIVes club and saying anything negative is taboo. Anyone saying anything negative is crushed with (p)curses. Only good mushy things are allowed here. So here it is: We will get our GCs by the end of the month. Hallelujah!

Congress and Senate are dominated by Democrats. If they think that is best for USA what is your problem? Wherever our interests meet, we need to support other things. Also if amnesty (for lack of better words) is given by US Govt, (with proper border enforcement), then they will not be illegals. Hope you are getting big picture.
I personally had many meetings, they echoed the opinion that we are doing the right thing. That is the way things work in the capital. And they have very great opnion of Patton Boggs.

With LC substitution Going away and 45 days between LC and I-140 and people able to apply in July for i-485 , with in next 3 months, INS will have a good knowledge how many are pending and how many years it will take .
Poeple should be able to get EAD and enjoy their time.

I don't think the tech companies are lobbying (strongly enough, if at all) for EB GCs. They are happy as long as H1 quota is increased which I think they will get in one form or the other.

Neah, there were too many approved to be all squeaky wheels. I think I know what they did. On July 1st they ran a simple query and picked up every application that has had no outstanding RFEs and had cleared namecheck, and then assigned them a visa number. If your receipt is from June, you may have cleared namecheck by July 1st, so you got the number. The rest (fingerprint check and approval itself) is just technicality.
I am on the opposite spectrum of the processing - been pending since early 2006 in EB2 ROW. My namecheck cleared late August - guess what, I am still waiting, perhaps until new numbers become available in October (even though I am current). Even though I have been waiting longer, they really finished working on my petition in June of 2006, so everything on the CIS side, including an RFE was done in 4 months. So, I really do not think your case is an exception. Most current approvable petitions that are not stuck in namecheck are approved in 3-4 months. So, in my opinion, quotas are the main culpit. Namecheck is easier to tackle because it gets a lot of bad publicity from delayed naturalization cases.
Sorry - My case is the exception, not the norm - it is a tiny percentage that got approved so quickly from Retrogressed categories. I do have a fairly early PD so that probably helped. To say that most current approvable petitions are processed in 3 - 4 months on average would be wrong.
But rapid fluctations of PD becoming current (as we saw this year) will not help at all (info from Ombudsman report)
* If the priority date became current today, due to delayed USCIS processing and thus underutilization of visa numbers, some have predicted that within a few months as many as 500,000 to 750,000 individuals now residing in the United States under a temporary worker visa could apply for a green card.
* Additionally, DOL’s recent backlog elimination efforts, scheduled to be completed by September 30, 2007, are predicted to add 70,000 or more approved labor certifications yielding as many as 170,000 additional green card applications.
* As USCIS begins to complete these applications and request visa numbers from DOS, the 140,000 statutorily authorized visa numbers will be used. DOS then will be required to retrogress priority dates.
o Consequently, most applicants in this scenario will find themselves trapped whereas they anticipated timely receipt of a green card, their wait exceeds seven or more years.
o In addition, all future employment-based green card applicants effectively would be barred from applying for many years.
You really don't seem to think there is a problem at all, so why are you here?

Besides, you are absolutely right. This country takes notice when people speak up! The problem is that that's not the case in our birth countries, and thus we are not hard-wired to speak-up! But if we make an effort we will definitely see the results! When people speak up and make a case for their basic rights then they are given those rights! But the rights will be taken away if we give them away, and the way to give them away is to remain quiet! This is a country where the fittest survive, and people will take what is yours if you do not claim it and/or protect it!

Buddy, if I were you, the first thing I would do is get a good and experienced lawyer on my side and have the lawyer look into these issues. You need a lawyer who has experience in handling such issues.
If you are not using your old lawyer anymore, you should immediately have your current/new lawyer file new G-28 so that you won't have to keep asking your old lawyer for anything. I did change my lawyer once and my second lawyer was able to get everything from my first lawyer.
MTR is no joke and it's worth spending some money on a good lawyer when it comes down to a denial of your AOS application. Good luck to you.
My friend, you have not seen the complete posting. I mentioned around 15 times that my lawyer has filed G-28 and AC21 together in May this year.
My lawyer is one of the best in southern California and i am with him since joining new company. He is going to check with TSC for G-28 and if they didn't updated one then i will have no choice but to ask old lawyer to forward the notice to me.

About who is SELFISH or not...yes, there are people who dedicated everything for the benefit of others, look around, you may surely find people. I define selfishness as "if we do things for our own sensual enjoyment" and not "basic survival". Both are selfish but grossly and signficantly different.
It is like eating the bare minimum to live and doing service to mankind or having a pizza party and just pretty much living for oneself oblivious of others.
This green card is just about me and my family members (99%)...dont you think so?

All done well after 180 days of 140.
Could not contact old employer today - will do tomorrow.
Thinking of taking info pass interview next week if I dont receive any thing by then.
Informed to attorney by mail today. As I receivied deniel email late in the evening could not contact any one today.
Hopefully all will end well with God s grace.

Option 4- Stay in H1-B status for 9+ years and you will become a religious person automatically.. after 9 years you will reach a level where no country, no citizenship, no relationship would matter....only MURTHY JI would matter.
It is my own experience.
You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
1. Get a Ph.D, get a job in a univ and apply in EB-1.
2. Get a MBA and get a management job and apply in EB-1.
3. Become a religious worker in some temple and apply in the religious worker category.

Admin fixes - some members were begging in train stations to get signatures on the admin fix letter. People waited outside places of worship, parties, schools, and other places, they were ready to s[pend money and time on these things, but why did 30K + members not want to even sign the admin fix letter.

One extremely dedicated member had a fast food stall during a festival and donated all the money to IV.
A lot of us have suffered with getting wrongful denials when we used AC21 - we started a campaign - but it just never picked up - some hundred letters went out to USCIS - and were ignored and we still see the same thing happening.
How much can the same people keep doing things again and again. We do need more help. IV is nothing but you and me and all of us.
For folks who are not happy with the visa bulletin. here is the reason why dates are not moving forward. USCIS are getting approvable cases with older priority dates and as they keep exhausting visas dates will not move forward. How the hell can USCIS get cases prior to 2001 ? The sad reality is - there are many cases - they could be "future employment, consular processing, labor subsitution, straight cases, cases lying withiout being adjudicated for various reasons ...... " as long as USCIS can get old cases to approve, dates will not move forward. If USCIS is sitting idle with no old cases, then DOS will move the date forward.
How can we resolve the above? Infighting won't help. We must unite and get our issues resolved. We must work towards admin fixes, we must work towards recapture, we must work towards other positive things that helps us.
Are we ready for helpingh ourselves? Lets stop infighting. Lets all join hands and help ourselves. Can we?
We need some new generation members who can help us. Let all members pledge - we are all united - we will come out of our shelles - we will not do infighting - we will not blame others for issues tht we all face

The sad reality is - there are many cases - they could be "future employment, consular processing, labor subsitution, straight cases, cases lying withiout being adjudicated for various reasons ...... " as long as USCIS can get old cases to approve, dates will not move forward. If USCIS is sitting idle with no old cases, then DOS will move the date forward.
How can we resolve the above? Infighting won't help. We must unite and get our issues resolved. We must work towards admin fixes, we must work towards recapture, we must work towards other positive things that helps us.
Are we ready for helpingh ourselves? Lets stop infighting. Lets all join hands and help ourselves. Can we?
We need some new generation members who can help us. Let all members pledge - we are all united - we will come out of our shelles - we will not do infighting - we will not blame others for issues tht we all face
Remember what Mahatma Gandhi said " Lets not blame others for weaknesses we all possess"

As U.S. employers, education institutions, and trade associations representing the future of American
innovation, we are writing to urge your support for three bills that will make necessary incremental
adjustments to the employment-based (EB) green card system. The measures � H.R. 6039, H.R. 5921
and H.R. 5882 � enjoy bipartisan support and should be enacted without delay this year.
America�s scientific and technological leadership is at a crossroads. To remain the world leader in
innovation, U.S. employers must have access to much-needed and sought-after highly educated talent �
including scientists, researchers, teachers and medical professionals. Foreign-born professionals make
great contributions to the U.S. economy and create good, high-paying jobs for all Americans.
U.S. employers rely on EB green cards to keep foreign-born talent living, working and innovating in
America. Yet, despite the critical importance of these visas, Congress has failed to address the well
documented backlogs in the EB green card system that leave some foreign-born, highly educated
professionals waiting over six to 10 years to receive a permanent resident visa.
The three bills will address many shortcomings in the EB green card system. For example:
� H.R. 6039, by exempting highly educated, foreign-born students earning an advanced degree in
science, technology, engineering or mathematics from a U.S. university from the annual EB green
card limit, would help U.S. employers retain these talented individuals in the U.S. workforce. For
example, foreign nationals comprise half of the master�s and 70 percent of the Ph.D.s in electrical
engineering from U.S. universities.
� H.R. 5921 will help put an end to multi-year wait times by eliminating unduly restrictive per
country limits on EB green cards.
� H.R. 5882 will help to reduce visa backlogs by �recapturing� EB green cards from prior years
that went unused due to government processing delays and making them available immediately to
those who meet the requirements.
Without these incremental reforms, U.S. employers will continue to be crippled in the global competition
for the world�s best talent, as more and more extremely valuable professionals from around the world
take their education and abilities to competitors abroad.
While permanent reforms for the EB green card system will be critical to U.S. employers� long-term
ability to hire and retain key worldwide talent, H.R. 6039, H.R. 5921 and H.R. 5882 are common sense,
incremental reforms that should be enacted this year. We again urge your support for these important
measures.
