And, since I suspect this is part of the problem look up "hypothetical". The correct term should have been "on or after July 2" not "after July 2". We have E-mailed 800+ IV members who have indicated they're from Michigan, Called some 30+.
We have got good response. We'll know the exact numbers when we meet. Confirmed members may not show up, others may change their mind at the last moment and just drop by. It's hard to predict right now.
A lot of members are interested in "Knowing" what we are doing. Best way to know is "Participate". By attending the meeting you're getting added to the "MI chapter circle of trust" - that is members we feel safe in passing on sensitive and confidential info we get from IV core. We also feel it safe to pass on information about activities covered by IV Non-disclosure policy such as Lawmaker meetings and responses we get, with members we have met personally, talked and know their background. Posting such sensitive info here or on the google groups is not possible as it will be picked up by anti-immigrants trolling IV for such info.
Bottomline : Anybody missing the meeting is missing the opportunity to have access to IV "insider information" which will never be made public to people outside the "trusted circle".
Worst case, even if around 20 guys show up, it's a great start as I've heard that some chapters started of with 5-10 people and now have 100+ members. Don't worry, we will get there.

Hey guys,
if you look at Page 8 of I-131, USCIS says that if you filed I-485 after July 30,2007, then you don't need to pay the $305 fees.
Assuming one filed I-485 on 1st August 2007, will he/she be exempted from this fees? Anyone had been in such situation?

I know i keep bumping this thread but I am surprised that no one has posted any experiences regarding the AP. I mean i see a TON of stuff about EAD renewals but nothing specifically about the AP. I guess ppl are more interested in making money than leaving the country (like ME ;) )

A lawsuit against USCIS for $20, thats cheap, I am in. BRC screwed me twice, when both labors went to BRC with no outcome then I filed third in PERM and thatwhy I am stuck with 2005 Sep PD with folks who just came to US in last 12 months and filing for 485 now. I know most of BRC folks are still stuck there and I am with them, lets get this cleared and have celebrations with all of us.

I totally understand the push from IV to encourage state chapters and build grassroots strength to this movement.
Join the state chapter : IV does not have a state chapter in the state I live in - Nebraska,: So I thought I would start one and wrote to IV ...after initial response from IV , there has been no progress .
Start contributing: I have already contributed $100 and will contribute further as and when I can.
Volunteer for IV: Volunteered to start the state chapter.
Well I have done my bit so hopefully I will not be disparaged for making comments on this issue,
Singlemost big bottleneck is lack of "Visa Numbers"...
485 applications pending :~340,000( ~ 320,000(recent flood) + ~20,000 SWAG on previously pending ).
visa numbers have been lost in the recent past - ~200,000 (This is the number thrown around)
Visa numbers available if we recapture :~340,000 (200,000 + 140,000 of this years quota)
So, if we had not lost those numbers, retrogression would be minimal/reasonable.
We could have even accommodated the skewness of India & china numbers, because each year India & China would have been benefitted by unused ROW numbers.
From my above understanding, the quota(140,000) fixed seems to be fine/reasonable, though per country quota is extremely unrealistic. But even this will not hurt much as long as unused numbers are used up by year end.
IMHO, demanding recapture is more an easy/winnable/achievable argument than the one to raise the quota itself .
Because the reason the visa numbers were lost is purely due to incompetencies of two federal institutions. State Dept and USCIS.
For two and half years (05 - 07 June) they artificially retrogressed the dates
way back to 1999 - 2001.
This prevented any approvals and new applications even though plenty of visa numbers were available(~ 200,000 cumulative).
For congress/senate it is easy to make their case for recapture citing incompetencies of these institutions rather than making case for "INCREASE" in numbers.
Many ways to achieve this objective- Ask for increase and settle for recapture.
Anyway - My point is Recapture will solve most of our problems and we should channel most of our resources to achieve this objective.

2. The dependent has an EAD. Is it necessary to include copy(ies) of the EADs with the AP packet?
3. If the previous AP has expired, is the applicationo process for a new AP different from that if a non-expired AP is being renewed?
4. I was reading in some threads that the $305 fee will be waived if there is a pending I-485. Is that correct?

There was a Telecon held yesterday night ( 9:00 pm - 10:30 pm) on establishment of news state chapters. Some core members as well as some veteran State Chapter leaders participated along with us greenhorns (newbies). Me, Chintu25 and CagedCactus participated from Michigan. Regretfully since it was a last moment decision , more members couldn't be invited to participate.
I was active in the Telecon almost to the last (I hope). It was a highly educative and informational to listen to the IV Core perspective on State Chapters. Veterans also pitched in with their experience in organizing their chapters (some super secret recipes were revealed :)). Some chapter leaders for new chapters also introduced some great ideas. To the end, I started bombarding the core with lots of questions, and they were patient in answering all of those ( b/n 10-10:30 pm!).
Unfortunately these matters cannot be discussed in the public forum here as we are monitored by Anti-Immigrants. Ditto for E-mails and PMs as we have no way of verifying the authenticity of the other person. So please don't feel offended if your PMs and E-mail inquiries remain unanswered!
ONLY way to get acquainted with the 'inside news' is to participate in the 10/20 meeting, details of which are published below. Be there if you wish to remain in the know.

I receive the standard IRS letter regarding stimulus rebate.
I took this letter and went to SSA office to apply for a SSN for my wife.
Point number 3 in ss-5 clearly says .....
"If you check "Legal Alien Not Allowed to Work," you must provide a document from a U.S. Federal, State, or local government agency that explains why you need a Social Security number and that you meet all of the requirements for the U.S. government benefit. NOTE: Not all U.S. State or local benefits are acceptable for non-work SSN purposes. Contact SSA to see if your reason qualifies.
If you check "Other," you must provide a document from the U.S. government agency that explains why you need a Social Security number and that you meet all of the requirements for a Federal benefit except for the number."
I believe that IRS letter should be treated as a sufficient reason for need of SSN. BUT THEY DIDN'T ENTERTAIN ANY OF THE FACTS AND DECLINED TO ACCEPT APPLICATION FOR SSN.
As long as you qualify for the stimulus payment, you can get a non-work SSN. You qualify as long as you are in the income levels specified, were a resident of the US in 2007 (substantial presence), and were in the US legally (have a valid visa). If you did not file a tax return, then you cannot apply for the SSN.
As far as the Social Security Act is concerned, the law states that they MUST give you a SSN if you qualify for any federally funded benefit. The question is: Is the Economic Stimulus Payment a federal funded benefit. The information in my original post makes a very strong case that it is.
Please post your experiences here, even if you are denied. Remember, the folks in the local SSA offices are bureaucrats, not lawyers, or judges, so don't expect much cooperation. However, if they deny you application, simply write them a short letter saying that you disagree and that you are requesting a "reconsideration."

Hi, we recently applied for COS to H-1B at California Service Center on May 26th under premium processing. So far we have not received even the receipt notice, neither have the checks been cashed. Just wanted to check with everyone if this is normal, or did they misplace the petition?

I hope they have some kind of link with DOL. Because my approved labor case status changed from Certified to Data Review and back to Certified.
