I would be the most happiest person if that happens :D
NOW (no order whatsoever) is what applies during that last quarter.
So, it doesn't really do anything for certain for anyone - except get us all on the edge of our seats "while supplies last".
Well, good luck to all! Let's see what happens.

You morons, You have spent so much time in useless discussions and anti-immigrants are laughing at your foolishness. Its high time your greencards applications get a denial or RFE. You will come crying to IV to save your status. Or else you will be deported. That is all you can do. You guys have got sub labor or faked your resumes and now you want someone to be accountable to you. First learn to be accountable to yourself and your values.
Here is what antis are telling you aholes:
As for you fuckers over at Immigration Voice that caused this temporary outage, keep it up. The more time you waste harassing me, the less time you have to send flowers to politicians, begging for your green cards.
Give it up, slumdogs. The whole H-1B thing was like a little tryout to see if you scumbags could fit into American society. Since it is clear that the bigoted, misogynistic caste mentality is ingrained in your DNA, we have to send you home. Maybe we will make you wither in limbo for 10-20 years, dangling a green card in front of your eyes, but the end result will be the same. You will have to leave.
Unfortunately some of you may not live long enough to see that open sewer of a sub-continent again. You may die here in America, in an accident, or by natural causes, or commit suicide like all the techies in India are doing.
Either way, by death or deportation, you will be gone.
And Americans can go back into I.T. once again and reclaim the industry that we created.

I think you can also switch using your H1-B. You can still invoke Ac21 on H1-B, just that EAD makes it easier to find new employers.
moreover, you will now have to spend approx 4K on H1 renewals every year.
I can see how it will affect many people's (including mine) spouses job prospects.
Assuming it takes longer than 12 months, what are the options here? I would like to understand what AC21 says. Is having an EAD a precondition of using the AC21 provision i.e. does it say -
"an employee after 6 months of filing 485 AND having an EAD in hand can switch jobs"
or does it say
"6 months after filing 485, the employee can switch"
thanks

Guys ,
We have to stick to immigration reform..
Let's not get into the medicare/social security/income tax issues.
That would open a complete new front on which the immigration refrom opponents can attack you...
Our organization has to steer clear of the landmine issues like Medicare, Social Security reform. Those issues have sank many political careers in washington...These issues are tar pits..swamps...
We are threading a needle here...the thicker your thread gets..the less likely it would get through the needle hole..
We have to maintain focus and not get carried away.
Guys,
I agree with msp1976 on this. We need to focus on only the retrogression issue; everything else is great for time pass till the 27th when the SJC reconvenes.

I would like to bring it to your attention the delays in LCA approval process at the two BECs, most notably the Philadelphia. I have been waiting for almost 2 years since the commencement of two BECs and have not recieved our apporvals.
Me and my family are suffering constantly due to these delays. Please take necessary measures to speed up the approval process.
I would be highly obliged if you look into this matter as soon as possible.

Yes, Can open an LLc or Inc even on H1. Make sure you look at tax laws in your state. A non operating entity also has to pay about $750/yr in Taxes (Varies from state to state) plus file annual reports etc all costing more $$$.
So think it through before incorporating.
With EAD ,can you register a LLC/Inc ? Has anyone tried this ?

Looks like they are changing the spillover rules again from Horizontal to Vertical this is bad news for EB2 I
Pardon my ignorance.... Can you enlighten me as how Vertical and Horizontal spillover works ? What exactly happens in Vertical spillover and how is it different from horizontal.

Not sure about which bank would be good but whichever bank you choose make sure that they give you a statement of how much interest you paid over the year. Most people don't realize that you can deduct interest paid for a home loan in India is tax deductible in the US. Just FYI.
You mentioned "you can deduct interest paid for a home loan in India is tax deductible in the US." Can you explain how? Is there any one some one you know or you claimed this before?
Thanks.

Thank you for your e-mail to the National Processing Center concerning
your case filed under the PERM program.
Our office can only respond to inquiries from the employer's contact
person or attorney/agent listed on the submitted 9089 form.
Atlanta Help Desk (17)
Above is the message, I got it from them. I can't contact my attorney, because that's our company policy. While the HR told me that they will inform me when my PERM gets approved.
Hope after 5 long years , my GC ambition will be completed this time. All the best for rest of the folks!!!

It's call reseach topic.. We have to find some USCIS support documents for each case. We need some earlier USCIS decisions for each senarios/theories.
RG provided few supporting CIS rules in earlier post and seems logical. But not sure if RG or RK is right.
It's confusing indeed.
My blog is based on RK's opinion. But we need some research and we also need clarification from USCIS.
If AOS is denied erroniously, one MUST be allowed to work - because it is not our fault.
Personallyif I can't work because it is not my fault, I am in trouble because I have a family to manage and a small kid to take care of.
