I have H 1B VISA but never went to USA....
1) now if i want to go there... will there be any problem
2) if I want to apply for another VISA work or Tourist... will i get?
You should not have a problem getting a different visa to come to the US to work or visit, assuming you qualify for the new status. It's not unusual for someone to get a visa that they never use.

Guys, looks like we are facing a veiled attack from the rival groups. It is evident from some posts. Since morning we are busy repeatedly saying same things to these people. Please send greeting cards with the same motivation we all sent flowers.
We should not look ungrateful. People will appreciate this community even more if we show gratitude too. The press we got for our non violence movement along the lines of Mahatma Gandhi, speaks of our integrity and our culture.
We have a strong cultural background, with Mahatma Gandhi as our visionary and ideal. We follow his principles and I am sure if he had been here today, he would have had the same drive to thank the government for revoking their decision and restoring faith in the immigrant community?

Dear fellow 'immigrants stuck in process' from MD,
I suggest that we all get together to discuss how we can help the effort that immigration voice has undertaken. I did attend an IV meeting in NoVa a few weeks ago, I am keen on pushing an initiative of meeting periodically to discuss how we can collectively help our cause on this side of the river.
Send me an PM to express your interest and I will send out an email with further information.
If the MD state chapter is already having meetings, please ignore this message; but some one please send me the information on when these meetings take place.
Also let me know what you all think of this proposal?

hi,
My company allows me to DIY my h1b renewal for my 2nd 3-year term of H1b. My title changed to SENIOR research engineer from research engineer last year. I have the same duty. When I fill out LCA/I129, which should I choose from:
a. New employment:
b. Continuation of previously approved employment without change with the same employer
c. Change in previously approved employment
d. New concurrent employment
e. Change in employer
f. Amended petition
My wage is ok. Are there any potential problems or things I need to pay attention if I file my H1b extension with new title? or it is perfectly ok?

My paper filed EAD ( and for my wife as well) has been pending since June 20th.
We called USCIS yesterday separately and both times they insisted that we needed biometrics and created SR for that.
Any one else had similar experience.?
Also I was trying to search for the Thread that has suggestions / steps to take to expedite the EAD. I think I'd qualify for severe financial hardhip since both of us will have to stop working if EaD doesnt come by October 18th.
Can some one point to that thread.

My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.
In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.

My I-140 & I-485 applications had been transferred to VSC for receipting and later my I-485 was transferred back to TSC. But my I-40 has been pending at VSC for close to 6 months with no signs of any processing. VSC seems to be still processing Apr 06 applications while TSC has been processing I-140 under 6 months. Realistically my application should have stayed at TSC, but was transferred to VSC due to receipting delays and balance the workload. But now my application is stuck at VSC. For no fault of mine, my applications ended up in VSC. There is no signs of PP starting anytime soon. Can I lodge a complain to ombudsman in this regard? Will they be able to help me? Who do I contact and where can I find all the information to lodge a complaint?

Does anyone know how slow/fast/better is the Counsular Processing back in India if you ever become eligible to do that?

Don't go for it. It may be fast but you are working with too many variables that may go wrong. I went back home last year for CP and suddenly I became a victim of retrogression. I missed my cutoff date by two days. Then I had to wait for about 3 months to get my H1 stamp. I was lucky that I didn't lose my job here.

Guys,
I am on L1 .My wife is working for a Indian s/w MNC and was earlier in L1.Once her project got over they sent her to India.She applied for vacation and came here on L2.During visa stamping the officer cancelled her L1 visa in passport.We applied for her EAD in July and are expecting to receive it in a few days.This is the first scenerio.
Secondly, we applied for 485/140/AP/EAD in the second week of Aug 07.No updates yet with regards to cheques/receipt notices etc.
We tried to contact her company's office here to look out for employment based on L2 EAD.But they mentioned that they wanted her to goback and come here again on her company visa.I really cant understand what is that for.
Now the question is
1.Is it safe for her to change to L1again and have visa stamped in India given our situation of GC.If so when.I mean after receipt notices/finger printing etc etc?
2.Any idea of y these companies doesnt employ their own staff who are in EAD.
Any one gone thru any of the above situations.?
