On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. Hi,

Gurus - I have few questions and I need your help:

1. My EAD/AP expires in June/July '08. Can I apply for their renewal now?

2. Will there be a finger-printing requirement for the renewal? We had finger print in June 2007 when we applied 485/765/131 together?

3. Is it better to efile or paper file?

4. I will be in India from April to June this year. I have an AP valid till end June. Can I file for EAD/AP renewal and leave for India in April. Is there any risk? I can still use my current AP to enter when I come in early June, right?

I am currently doing my MBA here on a H4 visa. I want to know if I would be eligible to apply for the H1 Visa ( in the 20,000 quota) without converting to
F1 status. Please advise.

You woulkd be eligible provided you have completed your MBA. If you are still working on it then you would not be considered an advanced Degree HOLDER.

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. My brother is in this situation, came on L1 in 2008 through company A (valid till june 2010) and got his H1B approved from company B. He went back to India before Oct 2008 and came to US in feb 2009 on L1 again. He now wants to use his H1B, can he do that and how?

Its okay to file the 485 at either texas or nebraska. Normally the lawyers file 485 to the same center where your 140 got approved. from.

I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?

Also what is considered my priority date since I havent/cant file an i-485 yet.

I have a break period of 4.5 months. May 15 - Oct 1st. I was wondering if its OK if I just take a course in fall or should I enroll for summer as well. My grace period will end Jul 15th but by that time I should have an I-20 with me for Fall. Is that fine?

Can i travel on my H1B and Advance parole (EAD) and maintain the same H1B when i come back to the US? I've heard rumors that I will be forced to use the EAD on arriving at the airport. Hence I will lose my H1B (They have been serving as backups to each other)

Here are some additional details:
- Currently working for a company as an employee on my H1B
- H1b doesn't have valid stamping (should i go that route and get that??)
- My 485 Pending. Priority date is Aug 2005 on EB3
- Indian Citizen but born in Africa (EB3 is Rest of the World)
- Have had my EAD for the past two years (havent used it).
- i switched over companies last year and ported the greencard process - AC21
- I have an expired Advance Parole i filed over an 1 1/2 years ago (never used it) and was planning on re-applying for it
- I've lived in the US for the past 15 years and have at no point been illegal.
- Planning to travel to Europe in June.
