New numbers are out on H-1B usage and the past week showed a substantial pickup in usage with more than 1700 numbers counted against the cap of 65,000. 36,600 H-1Bs have been counted now. I'm moving my exhaustion projection date up about two weeks. My target is based on a rolling four week usage average so variations from week to week are discounted. as far as I understand it, you will be eligible for AC21 in feb. As long a they do not withdraw your 140 you should be ok. Just switch to a different employer and invoke AC21 in feb. Disclaimer: consult an attorney to confirm.

Hi,
I am Vijay Vellabati, finished MS in Dec-06 and I got a job in Jul.
I am in my OPT(Optional Practical training). I did not get to file for my H1-B.
Can my company apply for Green card for me right now.
Because I need to keep my status, my OPT expires in Dec-07.
If anyone can get back to me, I would appreciate that.

Yes, green card is for future employment, your employer can apply for your greencard!!
But usually the greencard process takes so long that it is nearly impossible to get it in a year (the time you have in OPT) so the safe bet is to apply h1b otherwise in US-Masters quota if you have one. And take it from there.

The Senate Homeland Security and Governmental Affairs Committee voted today to scrap the controversial REAL ID law which will require states to begin implementing tough new standardized technology requirements for drivers licenses in just a few months. C-SPAN, the exclusive video chronicler of Congress, yesterday took a major step to loosen its copyright hold by announcing that it would no longer object to YouTube or bloggers posting its footage from the Hill or from federal agencies online. The content makes up about half the cable channel's programming.
Use of the video footage became awkward recently when Republicans accused Pelosi of "pirating" some clips for her new blog, the Gavel. C-SPAN explained that floor footage is shot by government cameras and that Pelosi was on firm ground using it. But C-SPAN did ask her to take down a clip of a committee hearing shot by a C-SPAN camera.
A C-SPAN spokeswoman said yesterday's action was a nod to the ever-changing technological landscape.

Hi,
I wanted to now how you guys are going about AP and I94 renewals.
If we use AP to come to US, then our I-94 is valid only for 1 year i.e till AP expires.. So, if we apply for AP renewal, what will happen to I-94? Do we need to renew it? If yes, what is the procedure?
And, If we have a valid H4 visa for 2 more years but started working on EAD, when we enter into US, do we need to use AP for sure or can use H4 as it is still valid? If we use H4, will our EAD become invalid?
Please let me know.

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

I got my H1-B visa on June 29, 2005 , I came to india on Jan 2009 . From Jan 2009 till now I have been staying in India , bcoz I was taking care of my new born daughter, now she is grown up and now I am planning to start working in US. Right now I got my H4 visa .
I came to know from someone that H1-B filing for this year was over in Jan 2011, so if I need to file a new H1-b , I have to file now and I will be eligible to work after Oct 1 this year. Is it true ? Is it not possible that a company files for a new H1-B under premium processing and I start working after 2 weeks of filing ? I don't want to wait that long(Oct 1) to work , I have few oppurinities coming up where I may get selected.
I have stayed in india from Jan 2009 till APril 2011. Now I am on H4 visa in US. Can I get a extension of my previous H1-B visa filed on June 2005?
I want to work ASAP.

a.) DO you need latest paystubs for filing for 485.
Suppose, i am working for company A and company B has filed for my GC, then how can this be provided.
b.) Even if i am working for company A, do i still need pay stubs or will a letter stating that "this job is available for the immigrant" suffice.
