If we could add some good things for legal immigrants (EB), and the bill gets passed in senate... what are the chances of getting it passed in house and reaching president's table. The reason for this concern is that same thing happened in Dec 05, when at the last moment all immigration stuff was reformed from budget recon. bill. I am sure IV must be thinking about this as well and would like to get IV team's views on this. Also wanted to thank IV team for taking so many efforts.

Hello All,
I wanted your advice. I filed for my 485. Then hit retro. Got married. Now got current in June VB. Want to apply wifes 485. EB2 India PD 15 March 04. Initially lawyer said he would do everything in one fees. Now he says he will charge 1000 dollars more since he is filing for wifes separately. I was wondering whether to do it myself. Is it advisable? Has anyone done it succesfully? If so what do you put on top of your application so that USCIS knows I am filing for derivative and my PD is current and so they wont reject the docs? Thanks.

my current employer filed for my labor in march 2005, got approved in march 2007, filed I-140 in April 2005,and while I-140 was pending filed I-485 in july fiasco. In sep-2007 got intent to deny of I-140 based on A2P(ability to pay), employer filed M.T.R in October 2007. I have my fingered crossed looking at the financial statment from employer for the year 2005. chances are the MTR will be denied too. Now I have a new job offer from another employer who is willing to do new H1b for me and may be a labor petition too. the question is I want to see what comes out of the current MTR. Here is the question;
1/- if I tell the current employer to contine the process(which I dont think he will have problem with) and join the job on h1b will my I-485 status be changed or will it effects the current process?
2/- I am currently runnig on sixth year of h1b and my current visa expires in 2010 bades on the pending process with current employer. if I join the new employer on h1b what will be the H1b status will be?

Hello
I am in AOS with priority date of EB2 Dec 2006. We are moving out of USA due to spouse getting a job outside of USA. If we want to retain our priority date and green card, what are we supposed to do before and after we leave USA?
In case we want to make temporary visits to the USA, do we have to apply for visitor visa? I am assuming that we will not have AP since we are not inside USA. Will we even get a visitor/business visa since we have an immigrant visa which is pending with USCIS?

California taxpayers need to cover higher fees of private lawyers, who are hired by the state as the Attorney General's Office doesn't have the staff to handle all of the cases internally. In some instances, the state has employed outside counsel at hourly rates that reach $450 even while most of its in-house lawyers earn less than half that. Rates can be much higher, if the suits require private attorneys having a particular expertise.
Since January 2008, the Department of Corrections and Rehabilitation has signed about $24 million in contracts with private lawyers hired because the Attorney General's Office says it's too shorthanded to take the jobs. No, I haven't used Optimaze yet. Their reports say that SWF files are significantly reduced in size. I don't have any first-hand experience to tell you if it is true or not though :(

Yes I got it for my daughter. The CGNY website lists all the documents required. I sent
only the photo-copies of all the documents they mentioned, each page notarized.
I got PIO card in exactly a week and I live in North west Ohio close to MI border.

Hi!. I am helping my brother for his PERM. He has a BS Electrical Engineering in the Philippines. Is there a requirement to get an education equivalency assessment for PERM? Does he need to have a US Electrical Engineering license as a support for PERM as well?
He has not yet started yet. We are still studying several options. He also has 7 years experience in the Philippines. Can that BS +7 years outside the US count for EB2 PERM?

yup. you should have completed 180 days I guess after getting 140 approved. There are many threads for this discussion. try to find it.
Its not for the I-140. If you have completed 180 days after applying I-485 & I-140 approved, you can use the AC21. But if you have only I-140, there is no use.
