I am currently doing my MBA here on a H4 visa. I want to know if I would be eligible to apply for the H1 Visa ( in the 20,000 quota) without converting to

Immigration activists say they are hopeful that Gov. Deval L. Patrick will support proposals in an advisory report calling for more English classes for the state�s immigrants and in-state tuition for undocumented college students. Patrick released the report containing 131 recommendations, which he called a �values� statement, at a luncheon for immigrant advocates.
Since July 2008, resident immigrants and activists have crowded meetings around the state pressing for those programs and others, including allowing immigrants to get state drivers licenses.

My Status: US Citizenship
I'm planning to file GC for my parents (along with adjustment of status) when they visit me in a couple of months.
I'd a couple of questions regarding the birth certificate requirement.
They were born in Undivided India (before Aug 1947) and their place of birth is now in Pakistan. They migrated to India and have lived in a suburb of Mumbai most of their lives.
- I am planning to get affidavit of birth proving their place and DOB. Does this affidavit need to be on a Indian Govt issued stamp paper to make it look official?
- How do I get around Non availability or No record of the birth certificate requirement as their place of birth is in Pakistan. Can the municipal authorities of Mumbai issue this document?
Can somebody please help by sharing their experience if they are/were in a similar situation.

This is the scenario:
1. Husband becomes a LPR this year.
2. Wife still undocumented.
3. Wife was working long time ago, but became a housewife for the past 6 years, so no work.
How would the wife adjust her status under the new CIR if she was not working for the past 6 years?
Would she have to wait until the husband is able to petition her through other regular means?
Any ideas or is it too early to tell how USCIS will issue it's regulations about CIR?

Attorneys please advice on my case below....
I applied for an I-485 during July Fiasco under EB3 category with an approved I-140(EB3). EB3 priority date is October 2005.
I also started another process later in EB2 category with same employer. My EB2 I-140 finally got approved recently and successfully porting the priority date from EB3 but did not file for I-485 in Eb2 yet.
Last week, my EB3 I-485 petition got approved even though my EB3 prority date is not current. I have got my welcome letter (I-797C) today. The COA is 26 on the notice.
My questions are:
Is it approved by error?
What are the risks involved for now and down the road.
Can we travel outside United States using this GC.
Will appreciate any advice.

OED defines Visa as "An endorsement on a passport indicating that the holder is allowed to enter, leave or stay for a specified period of time in a country"
By that definition I believe that a visa can be issue anywhere, inside and outside of the country.

USCIS has announced that for the third week in a row, the H-1B count sits at 45,000 out of 65,000 used. I have applied for GC in Aug '07. I recently renewed my H1-B (7th year). I noticed that there is a mistake in the A# of my Green card application (Beneficiary #) on the H1-B approval notice.
Has any one else had this happen? Does any one know what can be done regarding this?

I applied for a green card via a relative application on April 28th of 2001. I am under the 245I law. It has been 10 years since the application and it has been approved. A lawyer told me I have one more year to wait since they are still working on the visas from April of 2001. My question is: What month are they on currently and is there any way I can speed up this process? Is there a website where I can keep track of where the visas are?

I am July 2nd filer and got EAD approved.
My 485 notice has Received Date as July 19th 2007 and Notice Date as October 17th 2007.
Do i need to calculate 180 days from July 19th 2007 OR Oct 17th 2007 if i want to change the jobs?

Because you already filed I-485 before she turned 21, your daughter is protected by CSPA and she will get her GC as long as your case is approved even if she turned 30 before your AOS is approved (I sincerely hope you are approved before she turns 30 as she must remain unmarried until she gets GC).
By the way, my son is in the same boat as he turned 21 in 2008 too.

My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

If my extension is rejected, I understand that I can apply for H4. (Since my husband is on H1)
Please help mw with few queries
1) Do I have to apply for H4 before my H1 gets rejected OR only after it gets rejected
2) Do I have to go back to India to get my H4 done
